Terms of Service

Magma Diver ("Magma Diver," "we," "us") operates a website and platform that connects divers ("Customers," "you") with independently owned and operated dive shops, boats, and instructors ("Operators") for the purpose of booking dive trips, rental gear, and related services. By creating an account, making a booking, or otherwise using Magma Diver, you agree to these Terms of Service ("Terms").

Magma Diver is a booking platform. We are not a dive shop, dive boat operator, dive instructor, or provider of scuba instruction, dive supervision, equipment inspection, or dive leadership of any kind. Every trip booked through Magma Diver is planned, staffed, and conducted entirely by the Operator you booked with, not by Magma Diver.

Magma Diver is not responsible for the conduct of any Operator, the condition of any vessel or rental equipment, the qualifications of any crew or instructor, or the safety of any dive. Your relationship for the dive itself is with the Operator, not with Magma Diver.

Scuba diving and snorkeling are inherently hazardous activities that carry genuine risk of serious injury or death, regardless of skill, experience, or certification level. By booking a trip through Magma Diver, you acknowledge and accept these risks. Nothing in these Terms or on the Magma Diver platform is a substitute for the Operator's own liability waiver, safety briefing, or dive-readiness assessment — you are responsible for reviewing and completing any waiver or paperwork the Operator requires, separately from Magma Diver.

You need an account to book a trip. In some cases — for example, booking through an Operator's own website using our embedded booking widget, or booking in person at an Operator's location — an account may be created on your behalf using the email address you provided. These Terms apply to that account the same as any other, and you can set a password to access it at any time using the link we send you.

You're responsible for keeping your account credentials secure and for all activity under your account. Let us know right away if you believe your account has been accessed without your permission.

Some trips require a minimum certification level. Certification information you provide is self-reported by you. An Operator may review and attest to a certification you've submitted as part of their own verification process, but that attestation is not a guarantee of accuracy and does not substitute for the Operator's own judgment about whether you're fit and qualified to participate in a given dive — Operators retain full discretion to decline participation on safety grounds, including on the day of the trip.

Trip and gear pricing is set by the Operator and shown to you in full before you pay — Magma Diver does not add hidden fees at checkout. Payments are processed by Stripe. Depending on the Operator's setup, funds may be routed directly to the Operator's own connected payment account, with Magma Diver retaining a platform fee, or processed by Magma Diver on the Operator's behalf. Either way, the total price you see at checkout is what you pay.

A booking is only confirmed once payment has actually been received and verified — not merely submitted. Gear you select at booking is reserved for your trip specifically and released if your booking doesn't complete or is cancelled.

Each trip has a cancellation policy set by its Operator, shown to you before you book and again on your booking confirmation. Refund amounts for a cancellation are calculated according to that policy based on how far in advance you cancel. An Operator may also cancel a trip (for example, due to weather or insufficient bookings), in which case you'll be notified and refunded in full for that trip.

You agree not to misuse the platform — including providing false certification or identity information, attempting to book on someone else's behalf without authorization, or interfering with the platform's normal operation or another user's use of it.

To the fullest extent permitted by law, Magma Diver's liability to you for any claim arising from your use of the platform is limited to the amount of platform fees you paid to Magma Diver in the twelve months before the claim arose. Magma Diver is not liable for any injury, loss, or damage arising from a dive trip, rental equipment, or the acts or omissions of any Operator — those claims are between you and the Operator.

We may update these Terms from time to time. If we make a material change, we'll notify you (for example, by email or a notice on the site) before it takes effect. Continuing to use Magma Diver after a change takes effect means you accept the updated Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

If you're a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect and why, and to request its deletion. Our Privacy Policy describes these rights and how to exercise them in more detail.
